I am looking to set up a full paid account but I was curious what this means? Is this turning over copyright licensing to BeFunky for any images my company creates?

"3.If you post Content to the Site, unless we indicate otherwise, you grant BeFunky and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such Content solely in connection with: (i) providing and promoting the Site and/or the Services; and/or (ii) exercising the rights granted in these Terms. You grant BeFunky and its affiliates and sublicensees the right (but, not the obligation) to use the name that you submit in connection with a BeFunky Image (only if you have elected to make such BeFunky Image public on the Site or by the nature of your service account your BeFunky Image is deemed public on the Site."

We spend a great deal of money on our photo shoots and our Model releases are for my company only, this seems like a huge conflict. We are very protective of our intellectual property. What rights exactly am I turning over to befunky? Is there I fee I can pay to have my images remain mine?

Hello Mike,

There is a public/private setting for your images that are saved to your BeFunky gallery. If you set it to public when saving an image to your gallery, BeFunky may use your image on the website (explore page) or other places. We would ask you if we want to use your public images for any other reason. Other than that everything is kept private and they belong to you.
